Welcome to Xparts By accessing or using our platform (website, mobile app, or services), you agree to be bound by the following Terms and Conditions. Please read them carefully before using the platform.

2. Definitions
• “Xparts” – The platform operator and service provider.
• “User” – Any individual or entity using the Xparts platform.
• “Vendor” – A registered seller or merchant listing products on the Xparts platform.
• “Installation Panel” – A registered service provider listed on the Xparts app for user reference.
• “Platform” – The Xparts mobile app and website collectively.

3. User Registration & Account Responsibility
• Users must be at least 18 years of age to register.
• Information provided during registration must be accurate and complete.
• Users are responsible for maintaining the confidentiality of their login credentials.
• Xparts is not liable for any unauthorized access due to negligence.

4. Product Listings & Pricing
• Product details, images, and pricing are uploaded by vendors.
• All prices are stated in Malaysian Ringgit (MYR) and are exclusive of SST, where applicable.
• Xparts is not responsible for errors in stock, product descriptions, or price changes.

5. Ordering & Payment
• Orders are confirmed only after successful payment.
• Payments are processed securely through certified gateways in accordance with the Financial Services Act 2013.
• Xparts reserves the right to cancel or refund any order in case of errors, fraud, or stock unavailability.

6. Delivery Policy
• Xparts offers same-day delivery within a 100km radius, depending on time of order, product availability, and delivery conditions.
• Deliveries are fulfilled by freelance p-hailing service providers registered under Xparts, not by third-party courier companies.
• While we strive for timely delivery, delays may occur due to traffic, weather, or operational issues.
• Delivery tracking will be provided when available.

7. Installation Panel Service
• Xparts displays nearby installation panels as a value-added directory service.
• Users can view the specialization, rating, and contact information of installers.
• All arrangements, including pricing and scheduling, are handled directly between the buyer and the installer.
• Xparts is not involved in the transaction and does not take responsibility for installation outcomes or disputes.

8. Returns & Refunds
• Returns must comply with the Consumer Protection (Electronic Trade Transactions) Regulations 2012.
• Eligible products may be returned within 7 days of delivery, provided they are unused and in their original condition and packaging.
• Items not eligible for return include:
• Electrical or electronic components (unless faulty)
• Custom-made or special-order items
• Items marked as “non-returnable” or “final sale”
• Vendors must respond to return or refund requests within 7-14 working days.

9. Vendor Terms
• Vendors must be SSM-registered businesses and comply with Malaysian business laws.
• Vendors are solely responsible for product accuracy, inventory management, and post-sale service.
• Xparts may charge a commission per sale and reserves the right to suspend or delist vendors for non-compliance or unresolved disputes.

10. Platform Usage & Conduct
• Users agree not to misuse the platform for unlawful or malicious purposes, including but not limited to:
• Posting false or misleading information
• Uploading prohibited or harmful content
• Attempting to breach platform security
• Xparts reserves the right to suspend or terminate any user account found in violation of these terms.

11. Intellectual Property
• All branding, designs, images, and software on the Xparts platform are intellectual property of Xparts, unless otherwise stated.
• No user or vendor may reproduce, modify, or use Xparts content without written consent.

12. Data Privacy & Security
• Xparts complies with the Personal Data Protection Act 2010 (PDPA) of Malaysia.
• Personal data is collected solely for order processing, account management, and service improvements.
• Xparts does not sell or share personal data with third parties without consent, except where required by law.

13. Limitation of Liability
• Xparts’ total liability for any claim arising from product purchase, delivery, or platform usage shall be limited to the lower of RM 500 or the actual product value.
• This includes issues arising from delivery mishandling, service interruption, or vendor errors.
• Xparts will not be liable for any indirect, incidental, or consequential damages, such as lost profits or business interruption.
• Customers are encouraged to inspect goods upon delivery and report any issues immediately.

14. Dispute Resolution
• Any disputes should first be addressed by contacting Xparts Support at support@xparts.asia
• If unresolved, consumers may escalate the matter to the Tribunal for Consumer Claims Malaysia (TTPM).

15. Governing Law
These Terms and Conditions shall be governed and interpreted under the laws of Malaysia. Any legal disputes will fall under the jurisdiction of the Malaysian courts.

16. Amendments to Terms
Xparts reserves the right to amend these Terms & Conditions at any time. Users will be notified via the platform. Continued use of the service after updates indicates acceptance of the new terms.
